Thirteen years ago !!!??!

Wednesday was not the first time that Justice Dipak Misra ruled on how and when the national anthem should be played in a cinema. Nor was Wednesday the first time that public interest petitioner Shyam Narayan Chouksey had succeeded in getting a court order over an “insult” to the national anthem. Thirteen years ago, when he was a judge in the Madhya Pradesh High Court, Justice Misra had passed a detailed order on the imperatives of showing respect to the national anthem.
Then, the petitioner before the High Court bench headed by him was none other than Chouksey — the same person on whose PIL the Supreme Court bench led by Justice Misra Wednesday issued slew of directives.Speaking to The Indian Express, Chouksey described it as a “mere coincidence” that his PIL was heard by Justice Misra in the Supreme Court too, and maintained that his petition has highlighted several recent incidents of insulting the national anthem while annexing all other orders passed in the similar matter in the past.
In 2003, Chouksey moved a petition in the Madhya Pradesh High Court accusing producer-director Karan Johar of insulting the national anthem in his movie ‘Kabhi Khushi Kabhi Gham’. Chouksey complained that a scene in the movie depicted the national anthem in poor light. Further, he rued that people in the hall did not stand when the anthem was played.
Allowing Chouksey’s petition, Justice Misra, authoring the Division Bench judgment in July 2003, had ordered that the movie shall be withdrawn from all theatres and could not be shown unless the producer removed the scene depicting the national anthem in what the judgment said was “contrary to national ethos and an anathema to the sanguinity of the national feeling”.
This order was set aside by the Supreme Court in 2004. But later, on a review petition moved by Chouksey, the apex court recalled its 2004 order and agreed to reconsider various questions of law involved in this matter.
Finally, in November 2006, the top court brought the curtain down on this case, saying the questions of law were
being left open and that it would deal with the issues in some other matter. The Supreme Court, however, allowed the movie to be screened in its original form, without any cuts or deletion of the scene on the national anthem.
In his order as a high court judge, Justice Misra had said that “any person who shows disrespect to the national anthem in a way, has to be regarded involved in anti-national activity”.
The judge’s views were clear that “no one is permitted to pave the path of deviancy and introduce the theory totalistic individualism in the name of freedom of expression” and that the “national anthem being the honour, pride and symbol of India and it is basically being the symbol of sovereignty and integrity of India, every citizen is under the obligation to respect.”
The judgment added: “The national anthem is pivotal and centripodal to the basic conception of sovereignty and integrity of India. It is the marrow of nationalism, hypostasis of patriotism, nucleus of national heritage, substratum of culture and epitome of national honour…every citizen should remember that every word, deed and thought by him has to be indicative of the respect for the Constitution and the national anthem.”
Although Justice Misra said that it was not required for the high court to deal with the aspect of standing up of the audience when the focus had to be on the aspect of certification of the movie, the judge did say that it was not correct to argue that people did not need to stand up when the national anthem is played as a part of a feature film.
“The Apex Court in the case of Bejoi Emannuel has clearly laid down that when the national anthem is sung and if one stands up, it should not be treated as disrespect. If the aforesaid judgment is understood correctly it requires that audience must stand,” stated the judgment.
Referring to the controversial scene in ‘Kabhi Khushi Kabhi Gham’, the judge further said: “…it runs counter to the ratio laid down by the Apex Court in the case of Bejoi…as the audience in the film do not stand up immediately.”
In Bejoi Emannuel’s case, a two-judge bench of the Supreme Court had ordered a school in Kerala to take back three children who had been expelled for not singing the National Anthem, although they stood during the Anthem. The children desisted from singing because of their conviction that their religion did not permit them to join any rituals except in their prayers to Jehovah, their God. The top court ruled that there is no legal provision that obliges anyone to sing the National Anthem, and it is not disrespectful to the Anthem if a person who stands up respectfully when it is being sung does not join in the singing. It, however, did not deal with the issue of whether it would be disrespectful if a person chose not to stand during the National Anthem.
Meanwhile, on an appeal by Karan Johar against Justice Misra’s verdict, a three-judge bench led by then Chief Justice V N Khare set aside the High Court order on April 19, 2004, stating it was not mandatory to stand when the national anthem is played.
“We are satisfied that in view of the instructions issued by the Government of India that the national anthem
which is exhibited in the course of exhibition of newsreel or documentary or in a film, the audience is not expected to stand as the same interrupts the exhibition of the film and would create disorder and confusion, rather than add to the dignity of the national anthem,” it said.
However, Chouksey moved a review petition against this order, pointing out that he was not heard at the time of this order despite filing a caveat. On October 21, 2005, a bench headed by then Chief Justice R C Lahoti allowed his review petition and recalled the 2004 order. “In our opinion, the questions of law arising for decision have far-reaching implications and need to be noticed and considered by this Court,” said Justice Lahoti although he said that the issue of certification to the movie need not be gone into any further.

  • This matter later came up for hearing before another three-judge bench headed by then Chief Justice Y K Sabharwal on November 15, 2006. This time, the court simply disposed it of saying that the questions of law were being left open and would be determined in an appropriate case.

PAY 50% TAX ON UNACCOUNTED DEPOSITS, OR 85% IF CAUGHT: GOVT

INDIAN GOVERNMENT providing a window to black money holders, the Government on Monday proposed to levya total tax, penalty and surcharge of 50% on the amount deposited post demonetisation while higher taxes and stiffer penalty of up to 85% await those who don't disclose but  caught.
     Nearly three weeks after P M Modi announced junking high denomination 500 and 1000 rupee notes,
Finance Minister Arun Jaitley introduced a Bill to amend the Income Tax law which also provides for black money declarants a mandatorily depositing of 25% of the amount disclosed in anti- poverty scheme without interest and a four - year lock- in period. Those who choose to declare their ill- gotten wealth stashed till now in banned 500 and 1000 rupee notes under the Pradhan Mantri Garib Kalyan Yojana 2016, will have to pay a tax at the rate of 30% of the undisclosed income.
    Additionally, a 10% penalty will be levied on the undisclosed income as well as a surcharge called PMGK cess at the rate of 33% of tax ( 33%of30%).
    Further, the declarant have to deposit 25% of the undisclosed income in a scheme to be notified by the government in consultation with the RBI.
   The money from the scheme would be used for projects in irrigation, housing,toilets,infrastructure, primary education, primary health and livelihood so that there is justice and equality, said the statement of Objects and Reasons of the Bill.
   For those who continue to hold onto undisclosed cash and are caught ,existing provisions of the income tax law will be amended to provide for a flat 60% tax plus a surcharge of 25% of tax (15%), which will amount a levy of 75%.
  Besides, if the assessing officer decides he can charge a 10% penalty in addition to the 75% tax.
  The current provisions of the penalty on under- reporting of income tax at 50% of the tax,and charges are being made to them. Under - reporting/ misreporting income is normally difference between returned income and assessed income.The Taxation Laws ( 2nd amendment) Bill, 2016 proposes to amend section 115BBE of the income tax act to provide for a punitive tax, surcharge and panalty on unexplained credit,investment ,cash and other assets.Against current provision of 30% flat tax rate plus surcharge and cess,a steep 60% tax will be levied on such income together with no expense,deductions or set- off allowed.
   Also, the assessing officer can levy an additional 10% panalty ,taking the total tax incidence to 85% .The current provision for panalty in cases of search and seizure are proposed to be amended to provide for a penalty of 30% of income if it is admitted,returns filed and taxes paid. In all other cases,60% will be the penalty.
    Currently,the penalty is 10% of the income, if the income is admitted,returned and taxes are paid. Penalty is at 60% in all other cases.
   Under the new Pradhan Mantri Garib Kalyan Yojana, besides 50% tax, surcharge and penalty,a quarter of the declared income tax will be to be deposited in interest free deposit scheme for four years.
Revenue Secretary Hasmukh Adhia said the deterrent provisions were necessary so that people have the fear of hoarding black money.

भारत बंद एकदम हिट है !

 बात 'भारत बन्द' से शुरू हुई , और दो दिन में ही 'आक्रोश दिवस' में बदल गयी I विपक्छी दल बस नाम के रह गए हैं I नोटबंदी के मसले पर जनता कितनी तकलीफ़ में है, कितने ग़ुस्से में है, है भी या नहीं, 'भारत बन्द' के साथ आएगी या नहीं, और विपक्ष देश के कितने हिस्सों में 'बन्द' करा पाने की हैसियत रखता है, कहाँ उसकी इतनी ताक़त है? इन सभी प्रश्नों का उत्तर हमें कल के हुए भारत बंद की इस्थिति से जाहिर हो गया है I

विपकछी दल को ये एहसास था भी या नही की लोग उसकेसाथ खड़े हैं या मोदी जी के साथ ? सायद नही ! बस यो ही हवा में तीर चला दिए ,लगे तो लगे नही तो खट्टीI ये है भारत की राजनितिक  इस्थिति, कोई विपक्छी दल ही नही है I


बिहार में नीतीश कुमार बिदक गये, वह तो काफ़ी दिनों से ऐसे सिग्नल दे ही रहे थे. उधर बंगाल में ममता दीदी क्यों लेफ़्ट की हड़ताल का हिस्सा बनें और कर्नाटक, उत्तराखंड और हिमाचल में पहले से ही दुर्दिन की आशंकाओं से ग्रस्त काँग्रेस क्यों 'बन्द' के ग़ुब्बारे के फुस्स हो जाने का एक और ठीकरा अपने सिर फोड़े.
यूपी में मुलायम-माया एक पाले में आ ही नहीं सकते. इन राज्यों में नहीं, तो बाक़ी और कहाँ 'बन्द' हो सकता था? कहीं नहीं IImage result for नितीश

तो ऐसा विपक्ष है ही कहाँ, जो 'भारत बन्द' करा सकने का माद्दा रखता हो, जो केन्द्र की किसी नीति के ख़िलाफ़ पूरे देश में सड़कों पर लड़ सकता हो? विपक्ष के नाम पर हमारे पास जो कुछ है, वह बस रंग-बिरंगी चूड़ियाँ है, जो ज़्यादा से ज़्यादा बस एक काम कर सकता हI संसद में खनक सकता है और उसकी कार्रवाई ठप्प करा सकता है, कुछ बिल अटका सकता है. पिछले ढाई बरसों में यह काम उसने बख़ूबी किया है. इससे ज़्यादा की न उसकी औक़ात है और न उससे उम्मीद की जानी चाहिए IImage result for BHARAT BAND

 हमारे पास आधा विपक्ष है. यानी विपक्ष है भी और नहीं भी ! विपक्ष राज्यों में है, लेकिन देश में नहीं है! क्षेत्रीय दल हैं,  जो अपने-अपने राज्यों में चुनावी लड़ाइयाँ जीत सकते हैं या किसी और तथाकथित राष्ट्रीय दल को राज्य में घुसने से या बड़ी ताक़त बनने से रोक सकते हैंI
इनकी राजनीति शुरू भी चुनावी समीकरणों से होती है और ख़त्म भी उसी पर होती हैI इनकी  राजनीति के खूँटे भी अलग होते हैं, कहीं जाति, कहीं क्षेत्रीय अस्मिता, कहीं माटी-मानुस, कहीं क़द्दावर नेता और कहीं किसी 'क्रान्ति' की आस बतर्ज़ अरविन्द केजरीवालI


समस्या यही है! राष्ट्रीय स्तर पर विपक्ष का कोई विकल्प हमारे पास नहीं है. ले-दे कर काँग्रेस और लेफ़्ट. दोनों ही  घिसट रही हैं किसी तरह. देश के नक़्शे से लगातार उखड़ती-सिमटती हुई. दोनों ही विरासत से अभिशप्त.
लेफ़्ट तो ख़ैर बदलनेवाला नहीं, लेकिन चौदह की हार से भी अविचलित रही काँग्रेस सचमुच आज भारतीय राजनीति का सबसे बड़ा अजूबा साबित हो रही हैI
केवल भारत ही नही बल्कि पुरे विश्व में तेजी से राजनितिक हालत बदल रही हैं I. भारत में 2014 में नरेन्द्र मोदी की ऐतिहासिक जीत, ब्रेक्ज़िट और अमरीका में डोनाल्ड ट्रम्प को सिंहासन मिलना, इन तीनों लक्ष्यों को कैसे पाया गया, क्या इनके तरीक़ों में एक पैटर्न नहीं दिखता?


अपने कौशल से मोदी जी ने नोटबंदी जैसे मुद्दे पर हुई सरकार की तमाम विफलताओं को 'राष्ट्रहित'  और लोगों को 'देश के लिए त्याग' करने के लिए 'कंडीशंड' कर दियाIImage result for मोदी
उधर काँग्रेस के ख़िलाफ़ 'परसेप्शन युद्ध' कैसे लड़ा गया. काँग्रेस पहले तो 'मुस्लिम तुष्टिकरण' करनेवाली 'हिन्दू-विरोधी' सेकुलर पार्टी बनायी गई, फिर वह 'ऐतिहासिक भ्रष्टाचार की प्रतीक' बनाई गई और अब वह 'राष्ट्रहित की विरोधी' के तौर पर लीपी जा रही है. बदले में काँग्रेस ने क्या किया. कुछ नहीं. आक्रमण करना तो छोड़िए, अपने बचाव के लिए भी कुछ नहीं कर सका I

मूल मुद्दा एक है. कोई राष्ट्रीय विपक्ष दल  है नहीं और जो विपक्ष है,उसके नेता का अता पता मुझे मालूम नही I  कुछ क्षेत्रीय दल हैं, जो राजनीती समझने के लिए भी एक दुसरे का मुह तकते हैं I
राष्ट्रीय राजनीति में तो विपक्ष के नाम पर ऐसा सन्नाटा है जैसे की  सत्रुधन सिन्हा की फिल्मों में उनके खामोश कहने पर हो जाया करती थी I जब तक काँग्रेस अपनी जड़ता नहीं तोड़ती, नई राजनीति के अनुरूप ख़ुद को नहीं ढालती, तब तक देश में न कोई राष्ट्रीय विपक्ष उभर सकता है और न ही विपक्ष को कोई नेतृत्व मिल सकता है. तब तक मोदी जी जो कहें, वही सही!

A PLANT THAT EATS RATS !

' The Nepenthes Northiana' is a carnivorous pitcher plant mostly located in Southest Asia, eats small animals, mostly rats! It measures up to 20 centimeters in diameter and is formed by a tendril, which inflates into a large cup-shaped trap.

It grows a leaf out that shapes itself into an open tube and fills itself with acid, much like the human stomach. It colours confuse insects as well as some rodents into thinking it is food itself. The rat falls in, and digestion begins.

Image result for a plant that eats ratIt is believed thet there are around 600 species of pitcher plants. These plants are most familiar with the Venus flytrap. Even though they evolved so that they could catch insects, they still like to eat rats and mice every now and then.

A PSYCHOLOGIST walked around a room while teaching stress management to an audience.As she raised a glass of water,everyone expected they'd be asked the "half empty or half full" question . Instead, with a smile on her face,she inquired:"How heavy is this glass of water?" Answer called out ranged from 8oz.to 20oz.She replied,"The absolute weight doesn't matter. It depends on how long i hold it.If i hold it for a minute,it's not a problem.If i hold it for an hour,I'll have an ache in my arm.If i hold it for a day,my arm will feel numb and paralysed.In each case, the weight of the glass doesn't change,but the longer i hold it,the heavier it becomes."

   She continued," The stresses and worries in life are like that glass of wate.Think about them for a while and nothing happens.Think about them a bit longer and they begin to hurt.And if you think about them all day long, you will feel paralysed- incapable of doing anything."

  It's important to remember to let go of your stresses.As early in the evening as you can,put all your burdens down.Don't carry them through the evening and into the night.Remember to put the glass down!

INDIAN journalist malini subramaniam has been conferred with the international press freedom award for her reporting from the naxal - infested baster area in CG,one of the four journalists felicitated by the annual award for their commitment to a free press.

Turkey’s Can Dundar, chief editor of the daily Cumhuriyet, was another honoree. He was arrested on Nov. 26, 2015, after publishing an article alleging the government intelligence service sought to send weapons to Syrian rebel groups. He was charged with disclosing state secrets, espionage and aiding a terrorist group and was sentenced to five years in prison. He remains free, after spending 92 days in jail, while his appeal is considered.

Jailed Egyptian photographer Abou Zeid, known as Shawkan, was given an award in absentia.
Zeid has been jailed since Aug. 14, 2013, on charges of weapons possession, illegal assembly, murder and attempted murder, the charges levied against hundreds of protesters in the clashes between Egyptian security forces and supporters of ousted President Mohamed Morsi. He has denied all charges.

CNN’s Christiane Amanpour received the Burton Benjamin Memorial Award for extraordinary and sustained achievement in the cause of press freedom.

👳When MANMOHAN SINGH speaks, which he seldom does, it is worth listening. But his speech in Rajya Sabha today on the demonetisation issue was a let-down. Not because he is known for great speeches, but because what he said made only partial sense.
Image result for manmohan singhIf his purpose was to highlight the government’s failure in handling the fallout of demonetisation, that is par for the course. It is possible to accept his criticism (with some qualifications) that there has been "monumental mismanagement" of the process of demonetisation. The persistent queues before some bank counters seems to justify his hyperbole, if nothing else.

This is bunkum, and pure politics. If there was "organised loot and legalised plunder", that happened right under MANMOHAN SINGH’s nose, with the 2G, Coalgate and Commonwealth Games scams being exactly that. The former PM was directly linked to those instances of "organised loot" since A Raja pulled off the scam by forcing Singh to look the other way, and Coalgate happened in a ministry Singh was himself in charge of for a while
.
Another point he made was that demonetisation would reduce the GDP by two percentage points, but we won’t know if this is right till the year is over. But the best estimates of professional forecasters are far below what MANMOHAN SINGH’s crystal-ball has indicated. Goldman Sachs sees a 1.1 percent fall, Care Ratings 0.5-0.3 percent, Emkay Global 0.9 percent, Icra 0.4 percent, and ICICI Securities by 0.4 percent. Barring Ambit Capital, which adopted a faulty methodology to come up with an unbelievable GDP drop of 3.3 percent from earlier estimates, not one projection comes anywhere near what Manmohan Singh’s claims.
The third point Singh made was that demonetisation would "erode our people’s confidence in the currency system and in the banking system." For good measure, he added: "I would like to know from the prime minister the names of any countries he may think of where people have deposited their money in the banks but they are not allowed to withdraw their money. This alone, I think, is enough to condemn what has been done in the name of (demonetisation…".

Whether demonetisation and the replacement of old notes with new ones are enough to damage confidence in the banking system is questionable. One would have thought that prolonged inflationary policies through unabated money printing — which was what happened during UPA 2, when the fiscal deficit crossed 6 percent — would have done more to debase the currency than a demonetisation to replace currency notes. And just to refresh his memory, the first major bank scam happened during his watch in 1992, when Harshad Mehta actually looted bank cash to make hay in the stock markets. And as for restrictions on people drawing their own cash, any banking system can — at times — place such restrictions. Banks even now place restrictions on daily cash withdrawals from ATMs. When banks fail, then too restrictions happen.
Singh also seems to have forgotten the Indira Gandhi emergency, when the government froze a big chunk of citizens’ earnings in compulsory deposits in order to contain inflation. If that did not bother Singh, one wonders why the orderly withdrawal of deposits is a great curtailment of citizens’ rights.

The PM is addressing the issue on day to day basis.the opposition parties are severely critical of the style of functioning of the government .Only the common man is suffering for shortage of funds in the form of currency notes.The business is stand still. Black money in fact is a convertible proposition .The currency notes are not kept as such those are convertible in gold,bullion real estate, land, shares in stock exchange and in several other measures which are devised. Even on the fateful night of november 8 the jewellers allegedly converted the currency notes in gold and other ornaments to encourage the black money holders to escape.The country is engaged in the sole issue of black money.The national economy is also shattering because of political and bureaucratic rampant corruption but such corrupt high uo themselves are in the drivers seat.As such the PM would have to be very cautious in addition to adopting ferocious postures.
